EULA - End User License Agreement

END-USER LICENSE AGREEMENT

FOR FlowBiz Products

IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you and FlowBiz Pty Ltd - ABN 96 092 808 814, or if not purchased from FlowBiz Pty Ltd, your selling agent.

By installing, copying or otherwise using FlowBiz Products (FlowBiz), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, FlowBiz Pty Ltd, or its selling agent are unwilling to license FlowBiz to you. In such event, you may not use or copy FlowBiz and you should promptly contact FlowBiz Pty Ltd, or your selling agent for instructions on return of the unused product(s) for a refund.

FlowBiz LICENSE

Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect FlowBiz.

FlowBiz is licensed, not sold.

1. GRANT OF LICENSE. This EULA grants you the following rights:
1.1. Software. You may install and use one copy of FlowBiz on the COMPUTER.
1.2. Storage/Network Use. You may also store or install a copy of FlowBiz on the COMPUTER to allow your other computers to use FlowBiz over an internal network, and distribute FlowBiz to your other computers over an internal network. However, you must acquire a dedicated license for FlowBiz for each computer on which FlowBiz is used or to which it is distributed. A single license for FlowBiz may not be shared or used concurrently on different computers.
1.3. Back-up Copy. You may make a single back-up copy of FlowBiz. You may use the back-up copy solely for archival purposes.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
2.1. Limitations on Reverse Engineering, Decompilation and Disassembly. You may not reverse engineer, decompile, or disassemble FlowBiz, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
2.2. Separation of Components. FlowBiz is licensed as a single product. Its component parts may not be separated for use on more than one computer.
2.3. Single COMPUTER. FlowBiz is licensed with the COMPUTER as a single integrated product. FlowBiz may only be used with the COMPUTER.
2.4. Rental. You may not rent or lease FlowBiz.
2.5. Software Transfer. You may permanently transfer all of your rights under this EULA only as part of a sale or transfer of the COMPUTER, provided you retain no copies, and you transfer all of FlowBiz (including all component parts, the media and printed materials, any upgrades, and this EULA and the recipient agrees to the terms of this EULA. If FlowBiz is an upgrade, any transfer must include all prior versions of FlowBiz.
2.6. Termination. Without prejudice to any other rights, FlowBiz Pty Ltd may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of FlowBiz and all of its component parts.

3. COPYRIGHT.
3.1. All title and copyrights in and to FlowBiz (including but not limited to any images, photographs, animations, video, audio, music, text and "applets," incorporated into FlowBiz), the accompanying printed materials, and any copies of FlowBiz, are owned by FlowBiz Pty Ltd or its suppliers. You may not copy any printed materials accompanying FlowBiz. FlowBiz Pty Ltd reserves all rights not specifically granted under this EULA.

4. DUAL-MEDIA SOFTWARE.
4.1. You may receive FlowBiz in more than one medium. Regardless of the type or size of medium you receive, you may use only one medium that is appropriate for the COMPUTER. You may not use or install the other medium on another computer. You may not loan, rent, lease, or otherwise transfer the other medium to another user, except as part of the permanent transfer (as provided above) of FlowBiz.

5. PRODUCT SUPPORT.
5.1. Product support for FlowBiz is not provided by FlowBiz Pty. Ltd or its subsidiaries, unless a contract for support is entered into with FlowBiz Pty. Ltd or your selling agent. If this is the case, then product support conditions are stated in the product support agreement.

6. DISCLAIMER OF WARRANTIES:
YOU AGREE THAT FLOWBIZ PTY. LTD HAS MADE NO EXPRESS WARRANTIES TO YOU REGARDING THE SOFTWARE AND THAT THE SOFTWARE IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. FLOWBIZ PTY. LTD DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, MERCHANTABLE QUALITY OR NONINFRINGEMENT OF THIRD PARTY RIGHTS. Some states or jurisdictions do not allow the exclusion of implied warranties so the above limitations may not apply to you.
LIMIT OF LIABILITY: IN NO EVENT WILL FLOWBIZ PTY. LTD BE LIABLE TO YOU FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF FLOWBIZ PTY. LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

7. General Disclaimer
The staff of FlowBiz have taken due care in preparing this documentation. Every effort has been made to ensure that this book is free from error or omissions.
